Ministry
Asked to Enforce Order on Hamilton
A
group of sixteen individuals and organizations held a press
conference on October 29 to release a letter they have sent
to the Ontario Minister of the Environment in regards to
the Red Hill Creek Expressway.
The
letter addresses the failure of the City to complete the
requirements of the alternative assessment process imposed
on the City by the Ministry when it exempted the City from
conducting a full provincial environmental assessment. The
letter asks the Minister "to take immediate steps to
ensure that an Order in Council issued by your predecessor
is complied with and fully implemented by the City of Hamilton
(formerly the Region of Hamilton-Wentworth), or in the alternative,
that this Order in Council is revoked by the Ministry because
of the failure of the City to meet the conditions attached
to the Order."
Each
of these individuals and organizations made formal written
submissions on the draft plan for the expressway in the
fall of 1998. They were promised a formal reply by January
1999, but have never received this. Paul Muldoon, Executive
Director of the Canadian Environmental Law Association,
also attended the press conference to explain legal questions
associated with the request to the Minister.
